Vacation Rental Terms & Guest Agreement

We want your stay to be comfortable, easy, and safe. These Vacation Rental Terms & Guest Agreement (“Terms”) explain the expectations that apply when staying at our property.

These Terms apply when they are incorporated into or accepted as part of a reservation. By completing a direct reservation and accepting these Terms, or by separately agreeing to them when required for a third-party reservation, the primary booking guest (“Guest”) agrees to follow these Terms and is responsible for communicating them to everyone in their group.

For reservations made through Airbnb, Vrbo, or another third-party booking platform, the applicable platform terms and policies also apply. If there is a conflict regarding a matter controlled by the booking platform, the applicable platform policy will control to the extent of that conflict.

1. Your Reservation

  • The property is provided for temporary vacation and short-term lodging only.
  • The person making the reservation is considered the Primary Guest and is responsible for the conduct of all guests and permitted visitors included in the reservation.
  • Only registered guests may stay overnight unless we provide prior approval.
  • The property may not be sublet, transferred to another party, or used by someone other than the person or group for whom the reservation was made.
  • The number of overnight guests may not exceed the occupancy approved in the reservation.

2. Property Layout & Sleeping Arrangements

This is a multi-level home with both stairs and an elevator.

Ground & Garage Level

  • Guests arriving by car will typically enter from the alley.
  • The covered garage area provides access to a second keypad-secured door. Beyond this door is the interior entry area with access to the stairs and elevator.
  • There is also a small nook beneath the stairs with a television and twin mattress, pictured with the “Gaming Zone” sign.
  • This area is intended as a casual hangout space and is not represented or designated as a formal bedroom or sleeping accommodation.

Bedroom Level

The next floor contains three bedrooms. Each bedroom has its own private bathroom and private balcony.

King Suite

The King Suite has one true king bed, a walk-in closet, and a private bathroom with a shower and double sinks. It is located toward the front of the property, closest to the commercial block in front of the home.

Queen Bedroom

This bedroom has one true queen bed, a private bathroom, and a private balcony.

Multi-Bed Bedroom

This bedroom contains:

  • One twin bed in the corner
  • One king-sized sleeping configuration created from two full-size mattresses placed together within the white bed frame
  • One pull-out trundle beneath the white bed frame

Guests acknowledge that the king-sized sleeping configuration in this room consists of two individual full-size mattresses placed together, rather than a single king mattress.

Main Living Level

  • The top floor is the primary living and gathering space and includes the living room, dining room, kitchen, and custom wet bar.
  • The wet bar includes an ice machine.
  • The kitchen is fully stocked for normal guest cooking and generally includes cookware, pans, dishes, silverware, cooking basics, spices, olive oil, an oven, stove, microwave, toaster, and other everyday essentials.
  • Because some items are consumable, we cannot guarantee an exact quantity or selection during every stay.

3. Check-In & Arrival

  • Check-in begins at 4:00 PM.
  • Early check-in is permitted only when specifically approved in advance.
  • When you arrive, please take a quick walk through the home and let us know promptly if anything appears damaged, missing, or not working properly. This allows us to address issues early and helps distinguish pre-existing conditions from anything that may occur during your stay.
  • If something breaks, stops working, or does not seem right at any point during your stay, please contact us as soon as possible so we can address it.
  • For life-threatening emergencies, always call 911 first.

4. Parking

The property provides four private parking spaces.

These include:

  • Two covered parking spaces in the garage area.
  • Two additional parking spaces directly behind the covered spaces on the paved area accessible from the alley.

Free street parking is also generally available in front of the property, although availability cannot be guaranteed.

Please park only in approved parking areas and do not block driveways, sidewalks, neighboring properties, garage access, other vehicles, or the alley.

If a garage door does not appear to be closing properly, hold the garage-door button down until the door closes completely.

5. Occupancy, Visitors & Events

  • Only registered guests may stay overnight unless prior approval has been provided.
  • Unauthorized parties and events are not permitted.
  • The property may not be used for receptions, ticketed events, large gatherings, commercial events, or similar activities without our advance written approval.
  • Approved visitors must follow the same House Rules as registered guests.
  • The Primary Guest is responsible for the behavior of everyone in their group.

6. Quiet Hours & Neighborhood Noise

  • Quiet hours are from 11:00 PM to 7:00 AM.
  • Please be considerate of neighboring homes and businesses at all times.
  • During quiet hours, outdoor conversations, televisions, music, the sound system, and other activities should be kept at a low volume. Whenever possible, gatherings should move indoors after 11:00 PM.
  • Regardless of the time of day or prior event approval, guests may not create excessive, disruptive, or unreasonable noise that disturbs neighboring properties.
  • Guests are responsible for following all applicable City of Gulfport noise ordinances and regulations during their stay.
  • Parties, amplified outdoor music, speakers directed toward neighboring properties, shouting, or other disruptive activity are not permitted.
  • Repeated or serious noise complaints may constitute a violation of these Terms and the House Rules.

7. Elevator & Stairs

The home contains both an elevator and stairs. Guests acknowledge that access between floors may require the use of stairs if the elevator becomes temporarily unavailable because of maintenance, a mechanical issue, weather, power interruption, or another unexpected condition.

Please:

  • Follow all posted elevator limits and operating instructions.
  • Do not force elevator doors.
  • Do not interfere with elevator equipment.
  • Do not attempt to repair or reset elevator equipment unless specifically instructed.
  • Supervise children when using the elevator.
  • Report any elevator problem promptly.

We will make reasonable efforts to address an elevator malfunction promptly but cannot guarantee uninterrupted elevator operation. If elevator availability is essential because of a mobility or accessibility need, please contact us before booking so we can discuss whether the home is appropriate for your stay.

8. Balconies & Outdoor Areas

Each bedroom has access to a private balcony, and the property includes additional patio and outdoor seating areas.

For everyone’s safety:

  • Children must be supervised on balconies.
  • Do not sit, stand, or climb on balcony railings.
  • Do not allow children to climb or sit on railings.
  • Do not throw or drop objects from balconies.
  • Do not place furniture against railings in a way that creates a climbing hazard.
  • Do not leave umbrellas unattended on balconies.
  • Bring outdoor cushions inside or secure them when not in use or when weather conditions require it.

Indoor furniture may not be moved outside, and large furniture pieces should not be rearranged without permission.

9. Heating & Air Conditioning

  • The home is equipped with air conditioning, heating, and ceiling fans.
  • Please keep balcony and exterior doors closed while the air conditioning is running. Leaving doors open while the system is operating reduces efficiency and may affect the home’s comfort and temperature.
  • Please notify us if the HVAC system does not appear to be operating normally.

10. Beach & Recreational Equipment

We provide a variety of recreational and beach equipment for guests to enjoy.

Depending on availability, condition, and safety considerations, equipment may include:

  • Two kayaks
  • Stand-up paddleboard
  • Bicycle or bicycles
  • Life jackets / personal flotation devices
  • Beach chairs
  • Cooler
  • Burley wagon
  • Pickleball equipment
  • Balls
  • Shovels
  • Beach toys
  • Water toys
  • Other recreational equipment

Use of recreational equipment is completely optional.

Kayaking, paddleboarding, bicycling, swimming, watersports, and other recreational activities inherently involve risks. Each guest is responsible for deciding whether an activity is appropriate for themselves and members of their group based on experience, ability, age, health, weather conditions, water conditions, traffic, and other circumstances.

Before using recreational equipment, guests agree to:

  • Inspect equipment before use.
  • Not use equipment that appears damaged or unsafe.
  • Use equipment only for its intended purpose.
  • Follow applicable laws and safety requirements.
  • Use appropriate life jackets and safety equipment.
  • Closely supervise minors.
  • Consider weather, tides, currents, traffic, and water conditions.
  • Stop using equipment if conditions become unsafe.
  • Return equipment to its designated storage area after use.
  • Never use kayaks, paddleboards, bicycles, or other recreational equipment while impaired by alcohol, cannabis, medication, or another substance that may affect judgment, balance, or coordination.

We do not supervise recreational activities and cannot determine whether a particular activity is appropriate for an individual guest. Nothing in these Terms is intended to waive a right or responsibility that cannot legally be waived.

11. Care of Recreational Equipment

  • Recreational equipment is provided as an amenity for registered guests and must remain with the property except during its normal intended use.
  • Please return all equipment to its designated storage area after use.
  • Guests may not permanently modify, disassemble, lend, sell, abandon, or improperly use property equipment.
  • Please notify us promptly if equipment becomes damaged, lost, or unsafe so it can be removed from use or replaced.
  • Guests may be responsible for loss or damage resulting from misuse, negligence, intentional damage, or failure to reasonably secure equipment, subject to applicable law and applicable booking-platform policies.
  • Normal wear and tear is not considered guest damage.

12. Hot Tub

  • Use of the hot tub is optional.
  • Guests are responsible for determining whether hot tub use is appropriate for themselves and members of their group.
  • Supervise children closely at all times.
  • Do not bring glass into or around the hot tub.
  • Do not use the hot tub while excessively impaired.
  • Follow any posted capacity or safety instructions.
  • Do not drain the hot tub.
  • Do not add chemicals, soaps, oils, bath products, or other substances.
  • Do not tamper with controls or equipment beyond normal guest operation.
  • If the water appears unusual, the equipment does not seem to be operating properly, or there is another safety concern, please stop using the hot tub and contact us.

13. Fire Pit

The fire pit may be used only when conditions are safe and its use is permitted by applicable laws, regulations, weather restrictions, and burn bans.

When using the fire pit:

  • Never leave a fire unattended.
  • Keep children appropriately supervised.
  • Use the fire pit only as designed.
  • Do not use gasoline or other inappropriate accelerants.
  • Do not burn trash or prohibited materials.
  • Keep combustible items at a safe distance.
  • Fully extinguish the fire after use.

Guests should not use the fire pit during high winds, unsafe weather, or any period when local authorities prohibit outdoor burning.

14. Children

Children are welcome, but this is a multi-level home with stairs, balconies, an elevator, garage areas, recreational equipment, a hot tub, a fire pit, nearby roads, and nearby waterways.

Parents and guardians are responsible for determining whether the property and its amenities are appropriate for the children in their group.

Children should be appropriately supervised, particularly around:

  • Stairs
  • Balconies
  • Elevator
  • Garage and parking areas
  • Alley
  • Hot tub
  • Fire pit
  • Bikes
  • Kayaks and paddleboard
  • Water
  • Recreational equipment

15. Pets

  • Pets are permitted only with prior approval and payment of the applicable disclosed pet fee.
  • If a pet has been approved:
    • Keep pets off furniture and beds unless the surface is appropriately covered.
    • Clean up after pets promptly.
    • Do not leave a pet unattended if it is likely to bark, scratch, damage property, or disturb neighbors.
    • Report pet accidents or damage promptly.
    • Keep pets under reasonable control at all times.
  • Guests are responsible for their approved animals and must comply with applicable law and booking-platform policies regarding service animals and other legally protected assistance animals.

16. Kitchen, Wet Bar & Appliances

  • Guests are welcome to use the kitchen, custom wet bar, ice machine, appliances, cookware, dishes, and other provided amenities for their normal intended purposes.
  • Please operate appliances according to their instructions and let us know if something is not working properly.
  • Do not attempt significant electrical, plumbing, appliance, elevator, HVAC, or mechanical repairs yourself.

17. Laundry, Linens & Towels

  • A washing machine is available for guest use, and hangers are provided for clothing storage and drying.
  • Bed linens, bath towels, shampoo, conditioner, body soap, and shower gel are provided.
  • Please use towels and linens only for normal bathing and sleeping.
  • Do not use towels or linens for:
    • Makeup removal
    • Hair dye
    • Cleaning
    • Spills
    • Shoes
    • Outdoor equipment
    • Other uses likely to permanently stain or damage them

18. Trash & Recycling

  • Please bag all trash before placing it in the designated outdoor bins on the side of the property.
  • Do not leave loose trash outside, as it can attract insects and wildlife.
  • Before checkout, please remove trash from the kitchen, bathrooms, and bedrooms and place it in the appropriate outdoor bins.

19. Property Care & Maintenance

Please treat the home and its contents with reasonable care.

Guests should promptly notify us about anything that could create a safety concern or cause additional property damage, including:

  • Water leaks
  • Plumbing problems
  • Electrical issues
  • Elevator problems
  • Broken doors or locks
  • Water intrusion
  • Significant spills
  • Appliance malfunctions
  • Hot tub issues
  • Broken or damaged recreational equipment
  • Significant accidental damage

Accidents happen. Prompt communication allows us to address a problem before it becomes more serious.

Guests should not attempt significant repairs themselves unless specifically instructed by us.

20. Damage & Excessive Cleaning

Guests may be responsible for reasonable costs associated with damage to the home, furnishings, equipment, or other property caused by the Guest or members of their group beyond ordinary wear and tear. This may include damage caused by misuse, negligence, intentional acts, unauthorized activities, or failure to report a problem that results in additional avoidable damage.

Guests may also be responsible for extraordinary cleaning required because the property was left in a condition substantially beyond what would reasonably result from a normal vacation stay.

Any damage or cleaning claim will be handled in accordance with applicable law and, for third-party reservations, applicable booking-platform policies.

Ordinary housekeeping and normal wear and tear are not considered damage.

21. Smoking & Vaping

  • Smoking and vaping are not permitted inside the home.
  • Guests are responsible for safely disposing of smoking materials when smoking is permitted outdoors and must never leave smoking materials unattended or dispose of them in landscaping, planters, or anywhere they could create a fire hazard.

22. Security & Access

  • Property access codes, garage information, Wi-Fi credentials, and other security information are provided for use by registered guests.
  • Please do not publicly post or distribute property access codes.
  • Guests should close and lock exterior doors and accessible windows when leaving the property.
  • Guests may not disable, disconnect, cover, remove, or tamper with:
    • Smoke detectors
    • Carbon monoxide detectors
    • Fire extinguishers
    • Locks
    • Security devices
    • Other safety equipment
  • The property is equipped with smoke detectors, carbon monoxide detection, a fire extinguisher, and a first aid kit.

23. Commercial Use

  • Normal remote work, video calls, and personal photography are welcome.
  • The property may not be used for commercial filming, professional productions, ticketed events, product launches, organized commercial retreats, commercial parties, or other commercial activities without advance written permission.
  • If you are interested in using the property for an approved retreat, production, event, or other special purpose, please contact us before booking.

24. Maintenance & Emergency Access

We respect our guests’ privacy and will not enter the property unnecessarily during a stay. However, there may be someone who stops by to maintain the yard and/or hot tub during your stay.

However, the owner, property manager, or an authorized service provider may enter when reasonably necessary to:

  • Respond to an emergency.
  • Address an urgent maintenance issue.
  • Investigate a safety concern.
  • Prevent or limit property damage.
  • Complete another entry permitted by applicable law.

Whenever reasonably possible, we will communicate with the Primary Guest before a non-emergency entry.

25. Weather & Coastal Conditions

  • Florida and coastal weather can change quickly.
  • Guests are responsible for monitoring current weather and local conditions before participating in outdoor or water activities.
  • The presence of kayaks, paddleboards, bicycles, beach equipment, outdoor spaces, or other amenities does not mean conditions are appropriate for their use on any particular day.
  • Guests should follow official weather alerts, evacuation orders, beach warnings, water advisories, burn restrictions, and emergency guidance.

26. Checkout & Departure

  • Checkout is by 10:00 AM.
  • Late checkout is permitted only when specifically approved in advance.
  • Before leaving, please:
    • Place used towels on the bathroom floor or counters.
    • Remove trash from the kitchen, bathrooms, and bedrooms and place it in the proper outdoor bins.
    • Close and lock doors and windows.
    • Make sure no umbrellas are left open or unattended on balconies.
    • Return recreational and beach equipment to its designated location.
    • Let us know once you have departed.
  • Guests are not expected to perform professional cleaning before leaving.

27. Cancellations, Refunds & Payments

  • For reservations made through Airbnb, Vrbo, or another third-party platform, payment, cancellation, refund, damage-claim, and other platform-administered matters are governed by the terms applicable to that reservation.
  • For reservations made directly through our website, the payment and cancellation policy presented at checkout and incorporated into the reservation will apply.
  • Nothing in these Terms creates an additional undisclosed fee or changes the cancellation policy under which an existing reservation was made.

28. Serious House Rule Violations

Serious or repeated violations may result in appropriate action, including termination of the stay when permitted by applicable law and applicable booking-platform policies.

Examples include:

  • Unauthorized parties or events.
  • Illegal activity.
  • Intentional property damage.
  • Dangerous activity.
  • Significant disturbances or repeated noise complaints.
  • Unauthorized overnight guests.
  • Occupancy beyond the approved reservation.
  • Repeated refusal to comply with material House Rules.
  • Tampering with safety or security equipment.

Any related claims or charges will be handled in accordance with applicable law and, where relevant, the booking platform through which the reservation was made.

29. Governing Law

  • These Terms are governed by the laws applicable to the property, including applicable Florida law and City of Gulfport requirements.
  • If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

30. Guest Acknowledgment

By accepting these Terms as part of a reservation, the Primary Guest acknowledges that they have had an opportunity to review:

  • The property description.
  • Sleeping arrangements.
  • The multi-level layout.
  • The elevator and stair configuration.
  • Parking arrangements.
  • Bedroom and mattress configurations.
  • Recreational equipment provisions.
  • Hot tub and fire pit rules.
  • House Rules.
  • Quiet-hour expectations.
  • Check-in and checkout requirements.
  • The applicable cancellation policy.

The Primary Guest agrees to communicate applicable rules and safety information to everyone included in their reservation.

Assumption of Risk, Release of Liability & Covenant Not to Sue

Guest acknowledges that use and occupancy of a vacation property, including its indoor and outdoor areas, stairs, elevator, balconies, hot tub, fire pit, garage, bicycles, kayaks, paddleboards, recreational equipment, nearby waterways, and other amenities, may involve inherent and other risks of personal injury, illness, property damage, disability, or death.

By choosing to stay at the Property and/or use its amenities, Guest knowingly and voluntarily assumes the ordinary risks associated with those activities and with use of the Property.

To the fullest extent permitted by Florida law, Guest, on behalf of Guest and Guest’s legal representatives, heirs, and assigns, releases and agrees not to bring a claim against Nailed It Girl, LLC d/b/a Sweet Drifts, together with its owners, members, managers, employees, agents, representatives, and property managers (“Released Parties”), for personal injury, death, or property damage arising from Guest’s use or occupancy of the Property or voluntary use of its amenities, including claims arising from the ordinary negligence of a Released Party, to the extent such claims may lawfully be released.

This release includes, without limitation and to the extent permitted by law, risks associated with the voluntary use of:

  • The hot tub
  • Fire pit
  • Elevator and stairs
  • Balconies and outdoor areas
  • Kayaks and paddleboards
  • Bicycles
  • Beach and recreational equipment
  • Garage and parking areas
  • Nearby waterways and outdoor recreational activities

Guest understands that recreational amenities are provided for convenience and enjoyment and that their use is voluntary. Guest is responsible for evaluating conditions, inspecting equipment before use, following provided safety instructions, supervising minors, and determining whether an activity is appropriate for Guest and members of Guest’s group.

This provision does not release or waive liability to the extent a claim cannot lawfully be released under Florida law, and nothing in these Terms is intended to waive liability for intentional misconduct or any other liability that applicable law prohibits from being waived.

By accepting these Rental Terms, Guest acknowledges that Guest has read this section, understands that it affects legal rights, and voluntarily agrees to its terms.
